DA won't seek death penalty in fatal Ligonier beating

A soldier accused of fatally beating a retired businessman won't face the death penalty if convicted of first-degree murder.

Authorities say 19-year-old Anthony Mowry, of Unity, beat 75-year-old William McMicahel Jones after becoming angry at Jones while they were having sexual relations in September. Authority say Mowry then set Jone's Ligonier apartment on fire and fled.

Westmoreland County District Attorney John Peck says he doesn't think the aggravating circumstances of robbery would outweigh mitigating circumstances beyond a reasonable doubt.

The defence has suggested the possibility of self-defence.

Jones was the grandson of the founder of steel company. He was also president of the Tribune-Review Publishing Co. in Greensburg from 1983 to 1988.
